Pegasus Sustainability Solutions, Inc. (“Pegex,” “we,” “us” or “our”) owns, operates and provides this web site (the “Site”), the software as a service made available by Pegex, accessible via the Internet, that provides functionality to facilitate communications related to the handling, storage, treatment, disposal, or other processing of waste (the “Pegex Platform”), and the computer programs and applications made available by Pegex or its agents that are specifically designed to access and use the Pegex Platform on a compatible device (the “Pegex Applications”). “Services” means, collectively, the Pegex Platform and the Pegex Applications.

THIS PRIVACY POLICY (THIS “PRIVACY POLICY”) CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN YOU AND PEGEX. IF YOU ARE ACCEPTING THIS PRIVACY POLICY ON BEHALF OF A COMPANY, YOU REPRESENT AND WARRANT THAT YOU HAVE FULL AUTHORITY TO ACT FOR AND TO BIND THAT COMPANY, IN WHICH CASE THE TERM “YOU” REFERS TO THAT COMPANY. BY USING THE SERVICES OR ACCESSING THE SITE, YOU CONSENT TO THE COLLECTION, USE, DISCLOSURE AND OTHER HANDLING OF INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

What information do we collect?

How can you delete or correct collected information?

How do we protect your information?

We use commercially reasonable safeguards to preserve the integrity and security of the information subject to this Privacy Policy. We do not, however, warrant the integrity and security of such information.

Your California Privacy Rights

Residents of the State of California, under the California Civil Code, have the right to request from certain companies conducting business in California a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes and a disclosure of the shared information. Please note that some web browsers and devices permit you to broadcast a preference to websites and online services that they “do not track” your online activities. We may collect information from other sources and combine that information with the information we collect through the Site and the Services. This Privacy Policy does not apply to any information we collect from any source other than the Site and the Services.

Governing Law; Jurisdiction

The Site and the Services are hosted in the United States. If you are accessing the Site or using the Services from outside the United States or any other region with laws or regulations governing personal data collection, use and disclosure that differ from the United States laws, please be advised that through your continued access to the Site and use of the Services, which are governed by U.S. law, you are transferring personal information to the United States and you consent to that transfer.

The laws of the State of Wisconsin and applicable United States law govern all matters arising out of or relating to the Privacy Policy and the Services, including, without limitation, interpretation, construction, performance, and enforcement, without giving effect to such state’s conflicts of law principles or rules of construction concerning the drafter hereof. You hereby irrevocably and unconditionally submit to the jurisdiction of the federal and state courts located in Dane County, Wisconsin for the purpose of any suit, action, or other proceeding arising out of or based upon the Privacy Policy, your access to the Site and your use of the Services, which courts are the exclusive forum for any such suit, action, or other proceeding.

Changes to this Privacy Policy

We reserve the right at our discretion to change the Privacy Policy at any time. We will post the most current version of this Privacy Policy to a privacy policy page on the Site.

If we make a material change to this Privacy Policy, we will notify either by posting a notice on the Site or by contacting you through the email address associated with your account.
